Judge rules in favour of DS flash carts in Europe

R4 flash cartridges have been used to play pirated gamesNintendo today lost its court case over the use of DS flash cartridges when the judge ruled that developers should be allowed to develop for the console at will.

During the ruling against Nintendo, in favour of the Divineo group the judge went on to suggest that Nintendo is “purposely locking out developers from their consoles” according to a report from Maxconsole.

Things should be more like Windows, apparently, where anyone can develop any application they wish to.

In short it’s a blow to the fight against for piracy for Nintendo. The ruling effectively means that flash carts are now legal in Europe.

Expect to hear more soon.
