Comments from the Colorado Department of Revenue
Following this case, a spokesman for the Colorado Department of Revenue (Daniel Carr) was keen to point out that card counting is not against Colorado state law, as long as you only use your brains.
On the other hand, marking cards or using any technological device to do so may be considered illegal.
